The EU New Battery Regulation: Compliance Standards and Traceability Systems

The European Union’s New Battery Regulation (Regulation 2023/1542), which entered into force in 2023 and is being phased in with strict deadlines through 2026 and beyond, represents a major shift toward a circular economy. It regulates the entire life cycle of batteries—from raw material extraction to production, reuse, and recycling.

Here is the breakdown of the key Compliance Standards and the Traceability Systems required under this regulation.

1. Key Compliance Standards

To sell batteries in the EU market (especially Electric Vehicle (EV) batteries, Light Means of Transport (LMT) batteries, and industrial batteries), manufacturers must meet strict sustainability and safety criteria:

 Carbon Footprint Declarations: Manufacturers must calculate and declare the total life cycle carbon footprint of the battery. Eventually, maximum carbon footprint thresholds will be introduced, and batteries exceeding these limits will be banned from the EU market.

 Recycled Content Targets: The regulation mandates the use of minimum levels of recycled materials in new batteries. For example, mandatory minimum percentages are set for recovered cobalt, lead, lithium, and nickel.

 Performance and Durability: Batteries must meet minimum electrochemical performance and durability requirements to ensure they last longer and can be repurposed (e.g., for second-life energy storage).

 Removability and Replaceability: For portable batteries used in appliances and electronics (like smartphones and laptops), the regulation mandates that they must be easily removable and replaceable by the end-user or independent operators.

 Due Diligence Policies: Large economic operators must implement a rigorous due diligence policy to address social and environmental risks in their supply chains, specifically targeting the sourcing of cobalt, natural graphite, lithium, and nickel.

2. Traceability Systems (The “Battery Passport”)

To enforce these compliance standards, the EU is introducing a groundbreaking digital traceability framework.

 The Digital Battery Passport (DBP):

By February 2027, every EV battery, LMT battery, and industrial battery (above 2 kWh) placed on the EU market must have a unique Digital Battery Passport. This is a digital twin linked to the physical battery via a QR code.

 Data Included in the Passport:

 General Information: Battery type, manufacturer, production date, and manufacturing location.

 Sustainability Data: Carbon footprint metrics, share of recycled content, and responsibly sourced material certifications.

 Technical Specifications: Rated capacity, voltage, temperature limits, and expected lifetime.

 State of Health (SoH): Real-time data on the battery’s health, remaining capacity, and history of use, which is critical for second-life sorting and recycling.

 Access Control: The traceability data will be tiered. Public data will be accessible to consumers via the QR code, while detailed technical and composition data will be restricted to repair shops, second-life remanufacturers, and recyclers.
